ASIC matters at Sutherland Local Court

The Australian Securities and Investment Corporation (“ASIC”) is a government body which acts as regulator for Australian companies, financial markets, financial services organisations and professionals who deal in investments, superannuation, insurance, deposit taking and credit.

ASIC carries out most of its work under the Corporations Act 2001. Some of its roles include:

  • investigating suspected breaches of the law;
  • issuing infringement notices;
  • banning people from engaging in credit activities or providing financial services;
  • seeking civil penalties from the courts; 
  • commencing prosecutions – conducted by ASIC itself, or by the Director of Public Prosecutions.

There is a list in Sutherland Local Court every month for those matters where ASIC act as Prosecutors, mainly for breaches of various sections under the Corporations Act.

At BRRT we can assist directors / companies with cases in that list. We can assist by appearing on pleas of guilty or not guilty, by preparing submissions and conducting hearings. We can also assist with adjournments.
